The ‘Loi Bertrand’
and public disclosure law

The law of 29th December 2011, on the “Strengthening of Health Protection for Medicinal and Health Products” established new regulatory stringency, transparency procedures (public disclosure law) for companies producing or marketing health or cosmetic products intended for human usage or providing services associated with such products.

The new regulatory framework for the public disclosure law obliges the companies concerned to make public:

  • The existence of agreements signed between certains actors in the field of health, including healthcare professionals
  • All the advantages, beyond a threshold above or equal to €10 (inclusive of taxes), procured to these actors by the company, either directly or indirectly
