Data privacy statement in application process

Introduction

The Air Liquide group respects your concerns about the privacy of the personal information you provide and respect its Group Privacy Policy accessible following this link. Your agreement with the terms of this privacy notice signifies your consent to the collection, use and disclosure of your personal information for purposes related to your job application. Therefore, it is recommended to read this privacy notice carefully before submitting your job application. Your agreement is valid for any future visits of the website, and you may revoke your consent according to the process indicated below.

What is the scope of this privacy notice?

This privacy notice applies to all personal data provided by you in your job application and the recruitment process whatever the application was made by replying to a job offer or by sending a spontaneous application to be inserted in a pool of applications. The controller of your personal data is the Air Liquide group company that edited the job application you are applying for or that processes your personal data in case of spontaneous application corresponding to its needs (hereinafter “Air Liquide”).   

How is your personal data collected and used?

Accordingly, Air Liquide uses the personal data you have provided to contact you and process your application if you have responded online to a job offer or if you have sent a spontaneous application and within the legitimate interest in assessing your suitability for the proposed job. If you are employed, your information will also be transferred to Air Liquide HR services for recruitment administration purposes.

Passive personal data collection

Some of the personal data stored on our server is provided by you voluntarily when you complete forms online, while other personal data is collected automatically.

In order to improve user browsing experience on our sites and for statistical analysis purposes, Air Liquide automatically collects certain personal data when you visit our sites:

  • your IP address: an IP address is assigned to your computer by your internet service provider so that you can access the web
  • the date and time you visit to the site and the pages you view
  • your computer’s operating system and the internet browsing software used
  • your login, if you browse restricted areas of the site
  • your browsing history within Group websites and the duration of your connection.

Depending on the case, we process such personal data with your consent when the law requires it (for example, in the case where the deposit of some cookies on your terminal requires the collection of your consent) or on the basis of our legitimate interest in proposing a website and improving its performance.

Who can access your data?

In the strict limit of data processing carried out for the purposes described above, your personal data will be accessed by the Air Liquide HR departments. Your personal data will be used solely by Air Liquide and will not be communicated to third parties except to (i) third party services providers of the information system that require access to the personal data within the system to provide such services as well as (ii) external companies involved in the recruiting process. Air Liquide requires these companies to adequately protect your personal data and not use it for any other purposes than the aforementioned. If the services delivered by these companies involve personal data transfers outside the European Economic Area, your personal data would be covered by the Standard Contractual Clauses that were set out by the European Commission and that we impose to our services providers, or by any other mechanism considered as necessary by the European Commission.

Given the international dimension of the Air Liquide group, some of the Air Liquide recipients may be established in countries located outside of the European Economic Area, where the data privacy legislation may differ from that in the European Economic Area. The Air Liquide group has thus taken steps to ensure an adequate level of protection of the transferred personal data. How can you manage your personal data?

In accordance with the applicable regulations on the protection of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, you have a right of access, rectification and erasure of your personal data, the right to oppose for reasons relating to your particular situation to the treatment of your personal data, as well as the right to set guidelines regarding the fate of your personal data post-mortem.

In addition, in some cases you may request to receive the personal data you have provided to us or, where possible, to send it directly to another controller.

In certain circumstances, you also have the right to obtain the limitation of the processing of your personal data.

For personal data processing requiring consent from you, you have the right to withdraw your consent at any time. The exercise of this right does not affect the lawfulness of consent-based treatment prior to withdrawal.

In the case that you would like to delete your personal data and/or remove your consent relating to the retention of your personal data and/or to remove your name and personal data from the candidate pool, you can:

You also have the right to file a claim with the competent authority for the protection of personal data.

How long will Air Liquide keep your personal data?

In case of refusal by Air Liquide of your application for a job offer, your personal data will be deleted after three months from the end of the application process, except where a longer retention is allowed by law for purposes of proof.

If you give your consent to be integrated in a candidate pool following a refusal by Air Liquide of your application for a specific job offer or because you sent a spontaneous application, Air Liquide will store your personal data for a period of twenty-four months from the last exchanges with you unless you ask for a deletion of your personal data before according to the process indicated above.

Modifications

Air Liquide reserves the right to modify or complete this privacy notice at any time. The update of this privacy notice is displayed at the beginning of this notice, effective immediately after its publication. Please check back periodically, and especially before you provide any new personal information.
